Terms of Service

1. Agreement to Terms

These Terms of Service ("Terms") constitute a legally binding agreement between you and WillProv Health Inc. ("Company," "we," "us," or "our"), operating DiaperGuard (the "Service"). By accessing or using DiaperGuard, you agree to be bound by these Terms.

If you do not agree to these Terms, you may not access or use the Service.

2. Description of Service

DiaperGuard is a subscription-based web application that helps parents and caregivers track baby-related expenses, set spending budgets, and receive alerts when approaching spending limits. The Service includes:

• Expense tracking and categorization
• Budget management tools
• SMS spending alerts
• Analytics and reporting features

3. Account Registration

To use DiaperGuard, you must create an account by providing accurate, current, and complete information. You are responsible for:

• Maintaining the security of your account credentials
• All activities that occur under your account
• Notifying us immediately of any unauthorized access

You must be at least 18 years old to create an account and use the Service.

4. Subscription and Payment

4.1 Free Trial

New users may be offered a 14-day free trial period. During the trial, you will have full access to the Service's features. No payment is required during the trial period.

4.2 Subscription Plans

After the trial period ends, continued access requires a paid subscription. Current pricing is $6.99 CAD per month. Prices are subject to change with 30 days' notice.

4.3 Billing and Renewal

• Subscriptions automatically renew monthly unless canceled
• You will be charged at the start of each billing cycle
• Payment is processed through our payment provider, Stripe
• You authorize us to charge your payment method on file for all subscription fees

4.4 Failed Payments

If payment fails, your access may be suspended or terminated. We will attempt to notify you and retry the payment method on file.

5. Cancellation and Refunds

You may cancel your subscription at any time through your account settings or by contacting support@diaperguard.app.

• Cancellation takes effect at the end of your current billing period
• You will retain access to the Service until the end of your paid period
• No refunds are provided for the current billing period
• No future charges will be made after cancellation

6. User Responsibilities

You agree to:

• Use the Service only for lawful purposes
• Provide accurate transaction and financial information
• Not share your account with others
• Not attempt to reverse engineer, hack, or compromise the Service
• Not use automated tools to access the Service
• Not upload malicious code or content

7. Data and Privacy

Your use of DiaperGuard is also governed by our Privacy Policy, which explains how we collect, use, and protect your personal information.

You retain ownership of all data you input into the Service. By using DiaperGuard, you grant us a license to use your data solely to provide and improve the Service.

8. SMS Notifications

By providing your phone number and enabling alerts, you consent to receive SMS text messages from DiaperGuard regarding spending alerts and account notifications. Standard message and data rates may apply.

You can opt out of SMS notifications at any time through your account settings.

9. Intellectual Property

The Service, including all content, features, functionality, software, and design, is owned by WillProv Health Inc. and is protected by copyright, trademark, and other intellectual property laws.

You may not copy, modify, distribute, sell, or reverse engineer any part of the Service without our express written permission.

10. Disclaimers and Limitations of Liability

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED.

DiaperGuard is a tracking and budgeting tool. We do not provide financial, investment, or tax advice. You are solely responsible for your financial decisions.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WILLPROV HEALTH INC. SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, OR CONSEQUENTIAL DAMAGES ARISING FROM YOUR USE OF THE SERVICE.

Our total liability to you for any claims arising from the Service shall not exceed the amount you paid us in the 12 months preceding the claim.

11. Termination

We reserve the right to suspend or terminate your account and access to the Service at any time, with or without notice, for:

• Violation of these Terms
• Fraudulent or illegal activity
• Non-payment of subscription fees
• Any other reason at our sole discretion

Upon termination, your right to use the Service immediately ceases and we may delete your account data.

12. Changes to Terms

We may update these Terms from time to time. We will notify you of material changes by:

• Posting the updated Terms on this page
• Updating the "Last Updated" date
• Sending an email notification to your registered email

Your continued use of the Service after changes take effect constitutes acceptance of the updated Terms.

13. Governing Law

These Terms are governed by the laws of the Province of British Columbia and the federal laws of Canada applicable therein, without regard to conflict of law principles.

Any disputes arising from these Terms or the Service shall be subject to the exclusive jurisdiction of the courts located in Vancouver, British Columbia, Canada.

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary so that these Terms shall otherwise remain in full force and effect.

These Terms, together with our Privacy Policy and Refund Policy, constitute the entire agreement between you and WillProv Health Inc. regarding the Service and supersede all prior agreements and understandings.
